I would like to start a restaurant delivery service?

I will try to get restaurants to agree to sign a contract for me to deliver for their restaurants. But, what about the restaurants that don't want to sign. Can I legally order food from them and charge a delivery fee to customers without an agreement with the restaurant?

  1. ask yourself this question, if you were a restaurant owner, would you trust an outsider to deliver their food.
  2. I've actually used similar services before when lived in Georgia and Michigan. It seems to me that restaurants who don't deliver will be eager for a new revenue stream, such as customers who can't pick up. Which in and of itself is selling point to them. Of course, they'll probably want you to ensure that delivery of the food would happen in a timely manner. (No picking up at 9pm and delivering at 10:30 pm.) As far as I can see, there doesn't seem to be anything "illegal" about not having an agreement with a restaurant. However, I doubt that you will be getting the best, fastest service from restaurants who don't willingly participate. Start off small, if necessary, with restaurants that will participate and see how it goes from there. You can always ask royal customers, i.e. friends and family, to recommend the service to their favorite restaurants. And as an FYI, the BIGGEST users of this service were offices. Lots of luck!
