Question about Immigration through Marriage? PLZ HELP!!!?
Hello everybody, I am a spanish guy married to a US citizen, I came on dec to the U.S. on a visa waiver program, came with my girlfriend (at that time), we were coming to have our baby boy in Boston (where my wife was born), she wanted to have it here, we weren't sure if we wanted to get married, we're both 20 so we were very confused and that's why I didn't apply for my K-1 Fiance visa, but then friends and family convinced us and we decided to get married like 3 weeks later and in feb we had our baby boy, then in march I sent my immigration forms to Chicago (I-130, I-485, I-765 and I-864). I tracked my envelope through the US Postal Service website and they delivered it on march 3rd, it hasn't been so long since they received it but I've seen other ppl here that sent the same forms even after I sent mine and they already have their appointments for the Biometrics and Fingerprints so can anybody please tell me in how long will I get my first letter from USCIS? My family from Spain is sending us money but sometimes is it not enough and obviously me as a father don't like this kind of life for my son and wife so I can't wait till I get my work permit and doing the right thing.

- My husband is British and I am a US citizen, naturally. He came here in Sept. on the visa waiver program (he had been in before, but had come back from working in England). He filed is I-130 in August, and then we filed the I-485 and the I-765 together in the beginning of December 2007. He recieved his employment authorization card last week. His greencard is still being processed, and he has an interview in May for the I-485. We had a baby in November, but that didn't change anything about his immigration status, which really stinks. The employment authorization (I-765) takes about 12 weeks. I know they had a huge surge in the amount of applications filed this summer right before the prices of the forms went up. Check out their website (www.uscis.gov) and look under case processing times. There is a link at the left. Look under the place where yours is filed and that should give you an indication. Good luck, I know it is a completely frustrating process..especially when you can't work. Congrats on the baby!
- Fraud division is probably deciding whether or not they want to be involved. You've certainly created the perception of fraud by doing this on a visa waiver rather than K-1. Immigration doesn't like that at all.
- It can take up to 4 weeks
- Just give it a couple of more weeks. Not all applications are processed in the order they were received. Just because you haven't received anything yet doesn't mean that their is anything wrong. It took 7 weeks for my friends to get their appointment for Biometrics.
- Why don't you read your answers that people wrote to help you.
- Getting in touch with the USCIS doesn't help. They are deluged wish such queries. Find a good immigration attorney who will tell you where you have gone wrong, and how to take it furthur.
