i went to the uk in 2001 on a student visa, which i re-applied for the following year, it was granted. The third extension i applied for was in 2004. I never recieved my passport from the home office. It did not worry me as i had heard that the home office sometime keep passports longer than usual. i moved in with my now husband in 2004 and we have lived together since then. we have a 2 year old daughter together and started saving to return to my home country in order to get married with my parents etc and in a religious ceremony. In order to travel i contacted the home office with regard to the return of my passport. They said it had been dispatched since october 2004 to my then college. I was in shock. I then contacted my college and they have no record of the passport being delivered to them. i contacted the postal service and they dont have record that run that far back. i was advised by my countrys embassy to report it lost and return with proof of this report in order for them to issue a new travel document, which i did and we returned to my home and got married. now im applying for a spouse settlement visa and im worried that this may affect my application as a breach of UK immigration laws. I dont know if this classifies as a breach as i had no idea that the home office could send your passport to the college or institution that you attended. I have not broken the law or done anything illegal during my stay and only had a couple of part time jobs which met the regulations with regards to working hours. My hubby a british citizen by birth and has a full time job, accomodation and i have also managed to secure a job upon my return. any advice would be great. thanks
