i was ebay scammed by a china seller through paypal, can someone explain how i would make a lawsuit?

ok, here is the deal. i was all like "i want a mp4 player that is off brand for only, what came to be, 41.90$" i got it and it would not use any videos and the quality was very poor and the headphones were even broken in one ear... so i contacted the seller, about 4 or 3 days after i received it, and told him or her that i need a refund. she said ok, so i waited a little because i had a lot of Business and stuff to carry out. i eventually shipped it out with usps flat rate box international, with a tracking number. after that, she said she was going on leave for 2-3 days and she would refund me when she came back. BUT, i kept trying to contact him or her for about the next 10 days. now to this day, it has been over 3 FREAKING WEEKS since she said she would soon refund me! i tried to go to paypal and ebay to get my money back, but it has been over 45 days so i could do nothing, even though it was not even 25% my fault because she said she would refund me already quite a time around 45 days. then while i was waiting for her to reply back, i basically ran out of time. =( so what im asking is that if ANYONE I MEAN ANYONE can help me either get my 41.80$ back or possibly help me make a lawsuit (while explaining completely, because i don't know any of that stuff) to get this stupid scammer back. right now i am offering a reward of 6.00$ to anyone who would go through the trouble of emailing me constantly and explaining stuff to help me, through paypal as soon as i get my 41.90$ back. it might not be much, but hell you can buy some cool stuff on ebay or even withdraw it and get some food, better than nothing right? also, i already know as i said that it wount help with claims and such on paypal or ebay, unless you know for a fact that you could help me like that, then i would not mention it. also, here is some info on the seller and some of me.:::: seller::: ebay name---tamstore003 ebay page---http://myworld.ebay.com/tamstore003?ssPageName=ADME:X:RTQ:US:1181 address (from what i know)--- Lee Man Fung(Tam) Room 1402, Block 4, Bian Jian Da Yuan pharse 2, Yan He Nan Lu, Luo Hu District, Shenzhen 518013 China seller e-mail----tamstore333@gmail.com me: name--- angus preston ebay name--- angusman2010 my email--- either this one or i'd rather you use my gmail--- angusman95@gmail.com if you fell like you want the 6 bucks then post an answer here (short) and either you can email me to help or i will email you. thank you so much for listening!!!!!

1. Next time , make your question short & to the point. Contact ebay & report & contact paypal. That is why you use paypal-to cover these disputes. You open a dispute dialog. They investigate & you get your $ back. It would be IMPOSSIBLE to do open a lawsuit for this (foreign country & too low amount). So forget the lawsuit.
2. Try a claim in the ebay resolution > 'resolve a problem' on the item. If your purchase was funded though Paypal and was linked to a credit card- do a chargeback
